Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the services provided by All Kind Wastewater (“Company”) in the state of Queensland, Australia. By accessing or using the services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you should not use the services.

1. Acceptance of Terms

By accessing or using the services, you represent that you are of legal age and have the authority to enter into this agreement. If you are accessing or using the services on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind such entity to these Terms.

2. Services

The Company provides wastewater services in South-East Queensland. These services may include, but are not limited to, the collection, transportation, treatment, and disposal of wastewater. The Company may offer additional services, features, or functionalities, which will be governed by these Terms.

3. User Responsibilities

a. Account Creation

In order to access and use certain features of the services, you may be required to create an account. You agree to provide accurate and complete information during the account creation process. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

b. Compliance with Laws

You agree to comply with all applicable laws and regulations when using the services. You are solely responsible for obtaining any necessary permits, licenses, or approvals required for the collection, transportation, treatment, and disposal of wastewater.

c. Prohibited Activities

You agree not to engage in any of the following activities:

• Violating any laws or regulations
• Misrepresenting your identity or affiliation with any person or entity
• Accessing or using the services for any illegal or unauthorized purpose
• Interfering with or disrupting the operation of the services
• Impersonating another person or entity
• Collecting or storing personal data of other users without their consent
• Transmitting any viruses, malware, or other malicious code
• Engaging in any activity that could damage, disable, overburden, or impair the services or the Company’s systems
• Attempting to gain unauthorized access to any part of the services or the Company’s systems
• Engaging in any activity that may adversely affect the reputation or business of the Company

4. Intellectual Property Rights

The services, including all content and materials provided by the Company, are protected by copyright, trademark, and other intellectual property laws. You agree not to modify, reproduce, distribute, transmit, display, or create derivative works of any part of the services, except as expressly authorized by the Company.

5. Privacy and Data Protection

The Company respects your privacy and handles personal information in accordance with applicable privacy laws. The Company’s Privacy Policy outlines the types of information collected, how it is used, and how it is protected. By using the services, you consent to the collection, use, and disclosure of your personal information as described in the Privacy Policy.

6. Limitation of Liability

To the maximum extent permitted by law, the Company and its officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with the services or these Terms, whether based on contract, tort, negligence, strict liability, or otherwise.

7. Termination

The Company may, at its sole discretion, terminate or suspend your access to the services at any time and for any reason. Upon termination, all rights and licenses granted to you under these Terms will immediately cease, and you must cease all use of the services.

8. Modifications to Terms

The Company reserves the right to modify these Terms at any time. The updated Terms will be effective upon posting. Your continued use of the services after the posting of any modifications constitutes your acceptance of the modified Terms.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the state of Queensland, Australia. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Queensland.

10. Entire Agreement

These Terms constitute the entire agreement between you and the Company regarding the services and supersede all prior or contemporaneous agreements, understandings, or representations, whether oral or written.
